Kadastra terms and conditions

Version of 18 October 2026 — replaces the version of 4 October 2026

Translation. These terms have been translated from French. In the event of any discrepancy, the French version is binding (Art. 16.2).

1. Provider, scope and acceptance

1.1 Kadastra (hereinafter “the Service”) is a private land monitoring service published and operated by PMAX SA, a public limited company under Swiss law, Chemin des Quiess 12, 1907 Saxon, Switzerland, registered in the commercial register of the Canton of Valais under number CH-621.3.006.895-2 (UID/VAT: CHE-112.203.929), hereinafter “PMAX” or “we”. Contact: info@kadastra.ch.

1.2 These terms and conditions (hereinafter “the Terms”) govern the subscription to, and use of, the Service's offer for private individuals (“Home”). The Home offer is intended for personal or family use.

1.3 The offer for professionals (“Pro”) is governed exclusively by the Kadastra Pro terms and conditions and their appendix “Data processing agreement”. These Terms do not apply to it.

1.4 To subscribe, you must be of age and have the capacity to act.

1.5 You accept these Terms by ticking the box provided for that purpose on the payment page, before registering your payment method and starting the free trial or, without a trial, confirming the subscription (Article 4.2). If you do not accept them, you cannot subscribe to the Service. PMAX keeps a record of your acceptance (email address, version accepted, date and time). The version accepted is sent to you with the confirmation of your subscription. Earlier versions of the Terms are available on request.

2. Description of the Service

2.1 The Service monitors the official notices published on the Swiss Official Gazettes Portal (amtsblattportal.ch, operated by the State Secretariat for Economic Affairs SECO), on which the Official Gazette of the Canton of Valais is published. It reports to you those that may concern the parcels you have registered:

  • building permit applications concerning a parcel, a neighbouring parcel or the surrounding area;
  • certain notices with municipality-wide scope (plans, regulations, official cadastral survey, expropriations).

2.2 Every alert links back to the original official notice. Alerts can be consulted in the application. They are also sent to you by email, as a rule on the morning following their detection, unless you have turned those emails off. Detection depends on when the notice is made available on the Swiss Official Gazettes Portal. No detection or delivery time is guaranteed.

2.3 The Service relies on data from third-party official sources: the Swiss Official Gazettes Portal, the data of the official cadastral survey and the federal geoinformation services (swisstopo). PMAX is not the author of this data and does not warrant its completeness, accuracy or availability.

2.4 The Service currently covers the Canton of Valais. Its scope and the types of notices monitored may change. A substantial reduction of the scope is treated as an amendment to the Terms (Article 15).

2.5 What the Service cannot see. The Service only processes what is published on the Swiss Official Gazettes Portal. In particular, it does not report:

  • works exempt from public consultation, which Valais law allows for works of minor importance that do not affect the interests of third parties (Art. 42 para. 3 of the cantonal construction act);
  • notices displayed only on the municipal public noticeboard or served personally on the neighbours;
  • notices from other publication bodies, in particular the Federal Gazette, unless the Service states otherwise;
  • notices in which the authority has misstated or omitted the parcel, the municipality or the location.

3. Prices

3.1 The Home offer is billed per monitored parcel. The price of each parcel depends on its rank: the first parcel costs the most, and each following parcel costs less than the one before. The price of a subscription is the sum of the prices of its parcels. The price list is presented on kadastra.ch; the total price of the chosen subscription is repeated before your payment method is registered.

3.2 Prices are given in Swiss francs (CHF), including VAT, with no additional charges. They are expressed per month for ease of comparison, but billed per period of twelve months, in advance.

3.3 PMAX may change its price list. A price change never applies to a period already paid for. It takes effect on the following renewal and is announced to you by email at least 30 days in advance. You may then terminate in accordance with Article 5. New prices apply immediately to new subscriptions.

3.4 The Home offer allows you to monitor no more than 10 parcels. Beyond that, or for use on behalf of third parties, the Pro offer applies (Article 7.5).

4. Formation of the contract and payment

4.1 Subscription takes place on kadastra.ch. Payment is handled by our provider Stripe, by payment card or by TWINT. PMAX never has access to your card details or your TWINT credentials.

4.2 Steps of the subscription:

  1. you choose the number of parcels to monitor;
  2. you give your email address;
  3. a summary shows you the number of parcels, the annual price, the length of the free trial, the date and amount of the first charge, and the automatic renewal. There you can correct your entries or go back;
  4. you accept these Terms and take note of the privacy policy;
  5. you register your payment method and confirm using the button “Start free trial” (or an equivalent, unambiguous label indicating that the subscription will become payable at the end of the trial).

The contract is formed as soon as step 5 is confirmed. No amount is charged at that point. We send you without delay, by email, a subscription confirmation containing the summary of the order and these Terms, together with a link allowing you to choose your password.

4.3 Swiss law provides no right of revocation for contracts concluded online: Articles 40a et seq. of the Code of Obligations do not apply. Consumers habitually resident in the European Union nevertheless benefit from the right of withdrawal provided for in Article 4.5.

4.4 Free trial. Your first subscription begins with a 14-day free trial, during which the Service is fully accessible. Your payment method is registered when you subscribe, but nothing is charged during the trial.

  • If you terminate before the end of the trial, from the “My account” page, no amount is charged and the subscription ends on the date of termination.
  • Unless you terminate, the annual subscription is charged automatically at the end of the trial, at the price repeated before you subscribed, for the number of parcels you monitor at that time, with a minimum of one parcel. The initial term of twelve months runs from that charge.
  • We remind you by email, at least 3 days before the end of the trial, of the date and amount of the charge, and of how to terminate.
  • If the charge at the end of the trial fails, Article 5.7 applies as for a renewal: we inform you by email, further attempts are made and the Service is maintained during that time; failing payment within 14 days, the subscription ends in accordance with Article 5.6, and no amount is due.

Once per person. The free trial is granted only once per person and does not apply to renewals. To check this, PMAX keeps a non-reversible hash of the email address and of the payment method used for each trial, for the period stated in the privacy policy. If the email address given has already had a trial, the summary under Article 4.2 says so and the subscription is charged as soon as you subscribe. If the payment method has already been used for a trial, the trial ends as soon as you subscribe and the subscription is charged immediately; the summary warns you of this before you confirm, and an email confirms it.

4.5 Consumers habitually resident in the European Union. If you are habitually resident in a member state of the European Union, you have a statutory right of withdrawal of 14 days from the formation of the contract, without having to give reasons for your decision. To exercise it:

  • send us an unambiguous statement, by email to info@kadastra.ch or by post;
  • you may use the form in the appendix, but are not obliged to;
  • it is enough for your statement to be sent before the deadline expires.

In the event of withdrawal, PMAX refunds you the full amount paid, within 14 days, to the payment method used, even if provision of the Service began during the withdrawal period. If you exercise this right during the free trial, no amount is charged.

5. Duration, renewal and termination

5.1 The subscription is concluded for an initial term of twelve months from the end of the free trial. Without a trial, because the email address or the payment method has already had one (Article 4.4), the subscription is charged as soon as you subscribe, and the initial term runs from that charge.

5.2 At the end of the initial term, it renews automatically for periods of twelve months, charged in advance to the same payment method, unless terminated. We remind you of the renewal date, its amount and how to terminate by email at least 30 days in advance.

5.3 Termination during the initial term. You may terminate at any time. Termination takes effect at the end of the initial term, until which the Service remains fully accessible. Subject to Articles 4.4 (free trial) and 4.5, the initial term is not refunded.

5.4 Termination after a renewal. After a renewal, you may terminate at any time:

  • with immediate effect, from the “My account” page or by email to info@kadastra.ch; monitoring stops at once;
  • or on a date of your choice, by email to info@kadastra.ch, or at the end of the period from the subscription management page.

PMAX then refunds you the unused part of the period paid for, by whole months not yet begun: the twelve-month period is counted in months from the date of the renewal; the month in which the termination takes effect has begun, the following ones have not. The refund equals the amount charged at renewal, multiplied by the number of months not yet begun and divided by twelve, rounded down to the centime. It is paid to the payment method used, without delay. The amount is shown to you before you confirm the termination, and repeated in the confirmation email.

This refund concerns the whole subscription that ends; removing a parcel without terminating gives rise to none (Article 6.2), and amounts paid during the period for adding a parcel (Article 6.1) are not refunded.

5.5 How to terminate:

  • from the “My account” page: with immediate effect during the free trial and after a renewal, or at the end of the period during the initial term;
  • using the link in each renewal reminder email, which opens the subscription management page without a password (termination at the end of the period);
  • or by a simple email to info@kadastra.ch from the address of your account, stating the desired effective date.

We confirm the termination to you by email, stating its effective date and, where applicable, the amount refunded.

5.6 At the end of the subscription, monitoring stops and your account is deactivated. It is deleted 90 days later, unless a new subscription is taken out in the meantime, which gives you back access to your parcels and your alert history.

5.7 If a renewal payment fails, we inform you by email and a further attempt is made. The Service is maintained during that time. Failing payment within 14 days, the subscription ends in accordance with Article 5.6, and no amount is due for the unpaid period.

6. Adding and removing parcels

6.1 Adding a parcel. You may add a parcel at any time, within the limit of Article 3.4. If all the paid parcels of your subscription are in use, adding one increases your subscription by one parcel: the price of that parcel for the period remaining until the end of the term is shown to you before confirmation, together with the amount of your annual subscription after the addition, and then charged immediately to your payment method. The parcel is registered only once that payment has been made. During the free trial, adding a parcel is free of charge; the parcel is included in the first annual charge.

6.2 Removing a parcel. You may remove a parcel at any time. Removal gives rise to no refund and no reduction of the current period: the place remains paid for until the end of the term, and you may register another parcel in it free of charge until then. On renewal, the subscription is billed for the number of parcels you monitor at that time, and never for fewer than one parcel; you are reminded of the amount in accordance with Article 5.2, and it is shown in “My account”.

6.3 PMAX never deletes a parcel because of your subscription. A parcel is removed only by you. At the end of the subscription, Article 5.6 applies.

7. User account and use of the Service

7.1 You undertake to give an accurate email address, to keep it up to date and to retain access to it: it is used to send the alerts and all communications relating to the contract. We advise you to check that our emails are not classified as spam.

7.2 You are responsible for the confidentiality of your password and for the use made of your account. In the event of unauthorised use, you inform PMAX without delay.

7.3 You check that each registered parcel does indeed correspond to the one you intend to monitor. The Service shows it to you on a map for that purpose before it is registered. Parcel numbers repeat from one municipality to another.

7.4 You use the Service in accordance with these Terms, the applicable law and the terms of use of the third-party data sources, in particular those of the Swiss Official Gazettes Portal. The following are prohibited in particular:

  • any automated or systematic extraction of data;
  • any action liable to disrupt the Service or to circumvent its limits;
  • using the Service to monitor a specific person, to build up records on persons, to approach or harass third parties, or for any purpose contrary to data protection or personality rights.

7.5 The account is personal. It may be neither resold nor made available to third parties. Use on behalf of third parties or for professional purposes, or monitoring more than 10 parcels, falls under the Pro offer (pro@kadastra.ch).

8. Indicative nature of the information

8.1 Kadastra is a private service and is not an official service. It is neither operated nor approved by the Confederation, the Canton of Valais or the municipalities. The information provided by the Service does not constitute an official publication and has no legal effect.

8.2 Only the official electronic notice is binding. Since 1 March 2023, these are the notices of the Official Gazette of the Canton of Valais on the Swiss Official Gazettes Portal. In the event of a discrepancy between information displayed by Kadastra and the official notice, the latter prevails.

8.3 Appeal deadlines run independently of the Service.

  • For information: for a building permit application in Valais, the period for lodging an objection is as a rule 30 days from publication in the Official Gazette. Other procedures have other deadlines.
  • The Service displays the publication date and the official text of the appeal instructions. Any countdown it presents is indicative.
  • It is for you to check the applicable deadlines in the official notice and, in case of doubt, with the competent authority.
  • The date on which an alert is received has no effect on when a deadline starts to run.

8.4 The Service may fail to detect a notice concerning your parcels, report one that does not concern them, or contain errors, in particular in the cases described in Article 2.5. It is a monitoring aid and does not relieve you of the vigilance needed to safeguard your rights.

8.5 The Service provides no legal advice. For any question relating to your rights or to a procedure, contact the competent authority or a qualified professional.

9. Availability and liability

9.1 PMAX uses reasonable means to ensure the availability and proper functioning of the Service. This is an obligation of means and not of result. The Service may be interrupted, in particular for maintenance or where the third-party data sources, over which PMAX has no control, are unavailable. PMAX endeavours to announce foreseeable maintenance in advance.

9.2 The price of the Service bears no relation to the value of the interests that a notice may affect, and the official notice remains freely accessible at all times. That is why, in the event of slight negligence, PMAX's liability, for all damage taken together, is limited to the amount you have paid for the Service in the twelve months preceding the event giving rise to the damage. This limit applies in particular to damage resulting from the loss of a right, a deadline or an opportunity because a notice was not reported, was reported late or was reported inaccurately.

9.3 The same limit applies to PMAX's liability for its auxiliaries and subcontractors (Art. 101 para. 2 of the Code of Obligations).

9.4 PMAX is not liable for non-performance or delay due to force majeure or an event beyond its reasonable control, in particular:

  • a failure or a change of the third-party data sources;
  • a failure of the telecommunications networks or of the hosting provider;
  • a cyber-attack despite appropriate security measures;
  • a decision of an authority.

9.5 PMAX's liability remains reserved for damage caused intentionally or by gross negligence, in the event of injury to life, bodily integrity or health, and in the other cases where the applicable law prohibits excluding or limiting it.

9.6 PMAX cannot be held liable where the damage results from your own fault, in particular:

  • registering the wrong parcel;
  • an inaccurate or inaccessible email address;
  • turning the emails off or not consulting the alerts.

10. Intellectual property and source of the data

10.1 The data of the official notices comes from the Swiss Official Gazettes Portal, operated by SECO, and from the authorities that issue them. It is re-used in accordance with the terms governing the use of that portal, and its source is stated in the Service.

10.2 The map data comes from the Federal Office of Topography swisstopo (“© swisstopo”). The parcel data comes from the official cadastral survey of the Canton of Valais. This data is used in accordance with the terms of its providers, and its source is stated in the Service.

10.3 Information specific to the Service, for example a distance or a match with a monitored parcel, is distinct from the official data and binds PMAX only, within the limits of Articles 8 and 9.

10.4 The name “Kadastra”, the interface, the texts and the code of the Service are the property of PMAX or of its licensors and are protected by the applicable law. Any unauthorised reproduction or exploitation is prohibited.

11. Account deletion, suspension and discontinuation of the Service

11.1 You may delete your account at any time from the “My account” page. Deletion is final, cuts off the Service immediately and ends the subscription. The financial effects of the end of the subscription are those of termination (Articles 4.4, 4.5, 5.3 and 5.4). The application warns you before confirmation. The effects of deletion on your data are described in the privacy policy.

11.2 PMAX may suspend or close an account in the event of a serious breach of these Terms or of abusive use of the Service, after informing you and, where possible, after inviting you to remedy the situation. If the closure is not due to your fault, the unused part of the period paid for is refunded to you.

11.3 Should PMAX discontinue operation of the Service, it would inform you at least 60 days in advance and refund you the unused part of the period paid for.

12. Data protection

The processing of your personal data is described in the privacy policy and in the cookie policy, published on kadastra.ch.

13. Communications

13.1 Communications relating to the contract are made by email: PMAX writes to you at the address of your account, and you write to PMAX at info@kadastra.ch. An email constitutes written form between the parties.

13.2 A communication from PMAX is deemed received when it has been sent to the address of your account, unless PMAX has been informed that delivery failed.

14. Transfer of the contract

PMAX may transfer the contract to another entity taking over operation of the Service, for example in the event of a restructuring or a disposal. You consent to this in advance. You are informed by email at least 30 days in advance and may then terminate, with a refund of the unused part of the period paid for. You may not transfer the contract without PMAX's agreement.

15. Amendment of the Terms

15.1 PMAX may amend these Terms, in particular where the Service, its data sources or the applicable law change. Any substantial amendment is announced to you by email at least 30 days before it enters into force, with the amended text and an indication of the changes.

15.2 You may then terminate your subscription with effect no later than the entry into force of the amendment. The unused part of the period paid for is refunded to you. Failing termination, the new Terms apply from their entry into force.

15.3 Purely editorial amendments, or amendments that are exclusively favourable, may enter into force upon publication.

16. Complaints, language, applicable law and jurisdiction

16.1 Any complaint may be addressed to info@kadastra.ch. PMAX replies within 30 days. The parties endeavour to settle their disputes amicably before any legal action.

16.2 These Terms are drawn up in French and translated into German and English. In the event of any discrepancy, the French version is binding, subject to the mandatory rules of interpretation applicable to contracts concluded with consumers.

16.3 These Terms are governed by Swiss law. If you are habitually resident outside Switzerland, this choice does not deprive you of the protection afforded to you by the mandatory provisions of the law of the state of your habitual residence, where that law is applicable.

16.4 You may bring proceedings against PMAX before the court of your domicile or before the court of PMAX's registered office, in Saxon (Canton of Valais). PMAX may bring proceedings against you only before the court of your domicile. These rules follow from Article 32 of the Civil Procedure Code and Articles 15 to 17 of the Lugano Convention. The other applicable mandatory provisions remain reserved.

16.5 If a provision of these Terms is invalid, the other provisions remain applicable. The invalid provision is replaced by the applicable statutory provision or, failing that, by a valid provision whose effect comes as close as possible to the intended purpose.
